I must say I was a little surprised to hear reports that Tom Cruise and Katie Holmes have separated and Katie has filed for a Divorce. This is Tom's third failed marriage. Fortunately for him, it appears that there is a Pre-Nuptial Agreement in place to protect his millions. However, Katie has been very clever and filed her proceedings in New York indicating she seeks sole custody of their six year old daughter Suri. New York Courts are apparently against granting shared custody when there are acrimonious parents. So unless 'TomKat' are able to put their personal feelings to one side and show an united front for the sake of their daughter, there may well be a battle ahead for the future care of Suri. I suspect that Tom will not give up without a fight, particularly as his Children from his second marriage Connor and Isabella remained with him following his Divorce from Nicole Kidman. As a couple it is reported that they are worth 275 million dollars so I'm sure there will be enough cash to go around. I'm also pretty sure that the terms of the Pre-Nuptial Agreement will be pretty tight. However if Katie is successful in her fight for custody of Suri, then there may be a hefty child maintenance payment. Lets hope that we don’t see another Basinger/Baldwin custody dispute that was lived out in the public eye a few years ago! By Lorraine Harvey, Family Law Expert
